Privacy Policy
We collect what we need to run a marketplace, we don’t sell it, and you can see and delete it.
Last updated October 2026
This is a starting template for a marketplace privacy policy and has not been reviewed by counsel. Privacy law varies by jurisdiction (GDPR, UK GDPR, CCPA/CPRA and others); have a lawyer review and adapt it before publishing.
1. What we collect
| Category | Examples | Source |
|---|---|---|
| Account | Name, email, username, profile photo, location, sign-in provider | You, or your social sign-in provider |
| Shop and payouts | Shop name, policies, payout account status (we never see full bank details) | You and our payment partner |
| Transactions | Listings, offers, orders, shipping addresses, tracking numbers, reviews, messages, cases | You, in the course of buying and selling |
| Payment | Card details are entered directly with our payment partner; we store a reference, the last four digits and the outcome | Payment partner |
| Device and usage | IP address, browser, pages viewed, searches, listings watched, referrer | Automatically |
2. How we use it
- To run the marketplace: show listings, process offers and orders, pay sellers, send order and message notifications.
- To build the price guide from completed sales. Price guide data is aggregated by model and condition and contains no personal information.
- To prevent fraud, enforce our terms and resolve disputes.
- To improve the service, with analytics on how features are used.
- To send marketing emails if you opt in. Every one has an unsubscribe link.
Where the law requires a legal basis, we rely on performance of our contract with you, our legitimate interests in running and securing the service, your consent for marketing, and legal obligations for tax and fraud records.
3. Who we share it with
- The other party to your order. Sellers see the buyer’s name and shipping address; buyers see the seller’s shop name and ships-from city.
- Payment partner to process payments and payouts, including identity verification required by law.
- Service providers for hosting, email delivery, image storage and analytics, under contracts that restrict use to our instructions.
- Carriers, where you buy a label through us.
- Law enforcement and regulators when required by law or to protect users from fraud or harm.
We do not sell personal information and we do not share it with advertisers.
4. What is public
Your shop page, listings, reviews you leave and receive, your username and profile photo are public. Your email, addresses and order history are not. Messages are private to the two parties and to our support team when a case is opened.
5. Cookies
We use strictly necessary cookies to keep you signed in and to protect forms against abuse, and a small number of analytics cookies to understand which features are used. We do not use advertising cookies. You can clear cookies in your browser; signing in will set the necessary ones again.
6. Retention
Account data is kept while your account is open. Order, payout and dispute records are kept for 7 years for tax and fraud-prevention purposes. Messages are kept for 2 years after the last message in a conversation. Sale records in the price guide are kept indefinitely in aggregated, non-identifying form.
7. Your rights
You can access and edit your profile from your account settings, export your data and delete your account from the same place. Deleting your account removes your profile, listings and messages; transaction records we must keep by law are retained but detached from your profile. Depending on where you live you may also have rights to restrict or object to processing and to lodge a complaint with a supervisory authority. Contact us through the help center.
8. Security
Data is encrypted in transit, payment details never touch our servers, and access to personal data inside the company is limited to the people who need it to support you. No system is perfect; if we learn of a breach affecting you we will tell you promptly.
9. Children
DownSwing is for adults. We do not knowingly collect data from anyone under 18; if you believe we have, contact us and we will delete it.
10. Changes and contact
We will post changes here and, for material changes, notify you by email or on the site before they take effect. Questions about privacy go to the help center.
