Terms of Service

These terms apply to everyone who uses DownSwing. They are written in plain language on purpose; where they are specific, they mean it.

This document is a starting template for a marketplace terms of service and has not been reviewed by counsel. Have a lawyer licensed in your jurisdiction review and adapt it before relying on it.

1. Accounts

You must be at least 18 to buy or sell. You are responsible for your account, for keeping your sign-in method secure and for everything done with it. One person, one account; shops are tied to a single owner. We may ask for identity or payout verification before releasing funds.

2. The marketplace

DownSwing is a venue. Sellers list their own items and set their own prices and policies; buyers purchase directly from sellers. We are not a party to the sale, we do not own or inspect the items, and we do not guarantee that any listing is accurate, except as provided under Buyer Protection (section 6).

3. Listings and conduct

  • Listings must describe the actual item, with your own photos, graded on the condition guide.
  • You may only list items you own and have the right to sell. See prohibited and restricted items.
  • Offers you make are binding for their stated period; an accepted offer must be completed at checkout.
  • All communication and payment for a sale must stay on DownSwing. Soliciting off-site payment is grounds for removal.
  • Be decent. Harassment, threats and discriminatory conduct toward other users are not tolerated.

4. Fees and payments

Listing is free. Sellers pay the selling fee and payment processing fee described on the fees page when an item sells; the rates in effect at the time of sale apply. Payments are processed by our third-party payment partner under their own terms; by selling you agree to those terms and to connect a payout account. Funds are held until delivery and the inspection window have passed, and may be held longer while a dispute is open. Taxes are your responsibility, except where we are required to collect them.

5. Shipping and delivery

Sellers must ship within 3 business days of payment, with tracking added to the order, packed appropriately for golf equipment. Risk of loss passes to the buyer on confirmed delivery. Local pickup orders are completed in person; we recommend meeting in a public place and confirming payment in the app before handing over items.

6. Buyer protection and disputes

Orders paid through DownSwing are covered by Buyer Protection for items not as described, damaged in transit, not received or counterfeit. Buyers must open a case within 3 days of delivery. We will review the evidence from both parties and make a decision, which may include full or partial refunds funded from held payments. Our decisions on cases are final as between the parties on the platform; nothing here limits your legal rights.

7. Trades

A trade is a sale in which part or all of the consideration is another item. Both items are subject to these terms as if sold, including condition grading and Buyer Protection. Each party is a seller of the item they send and a buyer of the item they receive. See how trades work.

8. Content and intellectual property

You keep ownership of the photos and text you post, and grant DownSwing a worldwide, royalty-free licence to use them to operate and promote the marketplace, including in the price guide and in search results. Brand names and logos belong to their owners; use them only to accurately identify the item you are selling. Sale data (model, condition, price, date) is aggregated into the price guide and is not personal data.

9. Prohibited uses

  • Scraping, bulk-downloading or reselling price guide or listing data.
  • Interfering with the service, other users’ accounts or our payment partner.
  • Using the service for anything unlawful, including sale of counterfeit or stolen goods.
  • Creating multiple accounts to evade a suspension or manipulate reviews.

10. Suspension and termination

We may remove listings and suspend or terminate accounts that breach these terms, with or without notice depending on severity. You may close your account at any time; open orders must be completed first. Sections 4, 6, 8, 11 and 12 survive termination.

11. Disclaimers and liability

The service is provided “as is.” The price guide is informational and not an appraisal or a promise of resale value. To the fullest extent permitted by law, DownSwing is not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose. Some jurisdictions do not allow these limits; in that case they apply to the extent permitted.

12. Changes and contact

We may update these terms. Material changes will be announced on the site at least 14 days before they take effect; continuing to use DownSwing after that is acceptance. Questions go to the help center. Our privacy policy explains how we handle your data.
